Echostar sues receiver distributor
Echostar is taking FTA set-top distributor Viewtech of Oceanside, Calif., and its founder and president, Jung Kwak to court for allegedly “distributing the requisite piracy technology and information to select individuals on Web sites or Internet discussion forums, who then offer the pirate software to consumers for download.”

The lawsuit was filed July 13 by EchoStar and its NagraStar unit, which provides Dish’s descrambler microprocessor “smart cards.”



The suit, alleging violations of state and federal law, asks the court: to issue an injunction to bar Viewtech from trafficking in FTA receivers and pirate software; for an order impounding all electronic copies of the software; for damages; and for an accounting and restitution by Viewtech for all of the gain and profit it derived by its allegedly illegal actions.

FTA set-tops can receive satellite signals that are either not scrambled or are scrambled but are available free-of-charge, typically ethnic and religious programming.

Viewtech is one of the top four FTA sellers, according to a report on FTA set-tops by The Carmel Group, “in large measure because of its superior customer service and support.”

“Whichever manufacturer provide the best piracy support, best features and functions at a price below $200 per FTA unit is going to sell a lot of FTA units,” The Carmel Group said. “This means companies like Dish Network in the United States and Bell ExpressVu in Canada are losing a lot of subscriber revenue … the FTA manufacturers and others associated with the multichannel-TV-piracy business are delivering a lot of illegal gains.”

The claims of lost revenue are all too familiar to consumers even though they never seem to be accompanied by any proof that people who engage in piracy of any kind would have spent money for the same products or services.

    Viewtech does make some good receivers but I have a different one. Dishnetwork lost me because I only watch about 6 of their channels. The price to get those channels was just too high. If they would provide a pay per channel deal I would start to reconsider. About 75% of those ignorant channels they make you get are the ones that push people in other directions.

    i enjoy my viewsats... but i prefer the coolsat EPG over viewsat.

    I am sure viewsat will win this battle, or at least i hope they will.

    They dont ship their boxes with the software loaded.... so i dont see how this can cause them any troubles.

    What receiver do you have sssharp?

    you want to know why you are loseing revenue sht heads? you wont cover hardware for long you refuse to let people pick what channels they want for a half the cost of a 50$ package (for 30$ I will happy with my top 20-30 channles) this is why you lose you want 2-5X for stuff people can get else where cheaper, screw if tis legal or not that will only nible on the bottm line and they have sprays for moldy arses it stops the itch and smells great too, my point being prices are stupid and consumers are grassing where the grass is greener.

    i have had them in the pst currently dont have one but they said it would be years before this case gets in the court and that this is a civil claim courts wont make a injunction before hearing it first viewtech isnt worried about the suit they sell the boxes legally its when the consumer puts third party software in the product then its illegal dish wont win the dont have all the money resources like viewtech they also are imported boxes from korea shipped blank

    I am enjoying the pansat 3500, it provides all of the necessary features that make these machines worth the price. I have not had the viewsat but did consider a while ago before taking the 3500.

    Oh man, maybe that's why they're going down more often then the others...

    I was just about to buy one, but now, I don't know... My cousin was telling that they had the most memory and the fastest processer or whatever.

    Recommendations??? Under $250 CAD if possible. I don't need any recorders or special features like that.

    I thought FTA stood for FREE-TO-AIR and as long as they aren't providing the hackware what can the US or the EU say about it. I read somewhere about NDS/Europe going after DreamBox trying to shut them down and even trying to leverage IBM to not provide CPU's to DreamBox. You got to love these governing body’s totally controlling our market place and aiding certain big businesses.

    I really would like to have the DreamBox DM8000-S it looks very sweet but at almost $1000 I might look at the CW-3000HD & Genpix SkyWalker CW3K which is almost half the price and is a PVR as well. It's no wonder why DreamBox is considered the best they are the most expensive by at least double everyone else’s price. They maybe worth the extra expense, I'm not sure since I haven't played with one but if someone else has compared them side-by-side please chime in. I do like the Antenna control the DreamBox provides.

    I have a DM500 (dreambox), a coolsat 4000pro, and a pansat 3500sd. Although some of the boxes have been out for a while, they still do the trick. Coolsat 4000 has always had trouble with EPG (electronic program guide). Could only get 1 hr's worth of EPG. Pansat is nice, but not many options. My dm500, the best. 12 hr's EPG, sometimes 7 days EPG, options for many, many skins. As for price, havn't checked, but last I heard was you could purchase this box for $200.00us. OK, double the price of $99.00 boxes, but tell me how many different FTA boxes can you buy at that price. This box has never let me down in what I can do with it, even streaming video through that to my xbox 360. If $200 is too much for ya, then maybe you should stick to your local cable company.

    Good info and sounds like DreamBox is worth the extra monies. I do think the crack about can't afford $200 was a little over the top though especially when I'm talking about their HD unit at almost $1000, I won't wast my monies on a SD unit. I didn't do a full web search but what I found the DM500 for was around $350 but I'm sure your right someone might have them for around $200.

    Dish Network lost me permanently when I fell behind 2-3 months in payments because I was broke. They sent the UPS man with some boxes for me to pack my equipment and ship it back. I looked at my budget and decided I could afford to catch back up on my payments. I called Dish Network and they told me there was no way they could restore my service and that I had to send the receivers back before they would talk to me about getting Dish Network service again. I blew them off for a month or two...then talked to them again. Same story. Would not let me talk to any sort of supervisor.

    Please, do not be naive and pretend to be ignorant; Echostar knows about all boxes out there, but I assure you that they do not know which box are problably working or not, or the most popular, or the most sold, or the best forum website for sharing encoding files.

    for example, Echostar will not find this info unless people like we see here, posting which box model are working, even you can see posted a web link pointing directly to a forum - check this one out - chuckdog (Newbie) 28 July 2007 14:57

    Also remember that the Dreambox is a true FTA (Free To Air) reciever, that is meant for legal satellite reception. Viewsat has since they came to be, gone for the dickhack pitch. Pansat and Fortec have been in the game for years, as have Dream Multimedia, so why weren't they mentioned? Because these are trueFTA recievers. They are meant for the reception of satellite feeds that are legal to recieve. That was viewsats fuckup.

    Don't know if Coolsat did what Viewsat did. I do now that Viewsat posted advertisements in particular websites about support for hacking dicknet. Thats why their in trouble. They were number 1 in sales for a reason, advertisements. But, in the wrong places.

    Every single FTA receiver out there is a good box, the difference to one another are the features and most important are the (files) support. besides that, it won't matter much. for example DreamBox has a vast advertisement all over the web, it is an excellent box, because its "open source" operating system, but everyone cannot afford to expend $1,000. Let's say, If DreamBox drops the price to a $200, with (pirate) support included; for sure will be the best FTA units sold in the market, I tell you right now - then Echostar will lawsuit them also. That's why all manufactures and distributors do not give illegal (pirate) support, as we speak most of the well-known forums are down offline or are closing their doors for the general public. So what's the point to compare one FTA to another? - the ones they're in financial trouble are the satellite providers, just because the way of handling business, it's not acceptable for customers, if they would give you "all channels available" for an affordable price, then would be no reason for getting a pirate FTA. but no, they want you to get TV packages...!..pay me and be happy.
