Mininova trial gets postponed
The civil trial against Mininova, brought forward by the Dutch anti-piracy outfit BREIN, has been postponed one month today.

The outcome of the case will determine whether the torrent indexing site will have to "actively filter" torrents from its index daily. If BREIN is triumphant, Mininova will be forced to remove all .torrent files that lead to unauthorized content such as pirated movies, music or TV shows.



“The reason for this postponement is solely due to personal circumstances of our attorney and has explicitly nothing to do with the content of the case,” says Mininova’s staff.

Additionally, Mininova President Erik Dubbelboer notes:

“The case wont say much about the legality of torrent sites, but it will give more insight into what measures BitTorrent indexers and similar services have to take in order to make sure that they don’t link to illegal content. In particular, it deals with the question of whether or not website owners have to actively filter content. In other words, is a notice and takedown policy sufficient or not.”

    It would be ridiculous for mininova to lose though. I use google for most of my torrent searches. I wonder why they aren't going up against the big search engines. Well, I know why but its so stupid to target popular torrent indexing sites instead of them.

    Shinraboy, you got that one right!

    All they are asking is that Mini do pretty much what youtube has to do. I don't think they have a chance but I have been surprised before.

    Probably old Mini will get brought down but not this year. Sooner or later they will nail ALL the torrent sites. You all ought to get it while you can. Even when they do, that will just force piracy down into harder to trace methods of distribution. Still, it will be a great victory for the media mafiaa. Not everyone will go to that next level. I know I will not. I, wisely, already have pretty much what I want. This year I am only filling in some holes.

    You can never have all the songs/movies you want. Even a Progressive Rocker like myself is constantly re discovering old material thus I use whatever means I can use to get the albums be it downloadhelper or torrents to Gnutilla to WinMX to Ares Galaxy. The best solution is decentralized torrents and torrent searches. That and anonymous p2p is the total solution.

    Vodoo you are only partially right. If you concentrate on music, and work on it long and hard enough you may not get everything you could ever want but you can get everything you can think of.

    Even if they had to "actively filter" like Youtube does, they can't possibly filter all the copyrighted material.. just like Youtube...
