Facebook sues social networking site for using "book" in its name

Facebook sues social networking site for using book in its name
Social networking juggernaut Facebook is suing a new website called Teachbook, which is designed to help teachers, administrators & parents share classroom resources with each other.

The suit alleges, "Misappropriating the distinctive BOOK portion of Facebook's trademark, Defendant has created its own competing online networking community in a blatant attempt to become Facebook "for Teachers.""

Facebook's lawyers are claiming that using the name Teachbook is intended to (and would) confuse people into believing the site is associated with Facebook.

While there's certainly truth to the claim that the use of "book" in Teachbook's name is intended to let people know it's a social networking site, it doesn't automatically follow that people will assume an affilliation with Facebook.

In fact it seems like an equally valid argument that the average person would assume the name implies Teachbook is an alternative to Facebook, and therefore not affiliated.

There certainly don't seem to be any similarities between the logos or actual websites.

Even if they win, this seems like a losing proposition for Facebook - at least when it comes to competing with Teachbook.

Teachers are somewhat unique in the world of social networking. Many are hesitant to use services like Facebook because they worry about how it will make them look to administrators, parents & even students.

Teachbook potentially offers them a place where they can interact with other teachers, school staff & parents without the stigma attached to other social networking tools.

But in order to do that they first need to attract the attention of educators. By suing, Facebook has likely given them a good head start in that area.

Instead of relying on word of mouth, they now have major media outlets around the world talking about their service.

Because morally and ethically they should not have to change it as it relates not to Facebook what-so-ever.

i mean I can see the problem if the site is named TeachFacebook, or FacebookTeach, if this is so serious to have a word "book" in it then they should sue everyone with "e book" or "i book" or "book" itself. hell, i shuold be getting sued because i'm using the word "book" on everything i'm talking about. facecrap is being asshole like baxter00 said.

Plus the word "Teach" fits way more with "BOOK"(get it? BOOK, as in SCHOOL) than with "Face".

Billion dollar company suing a low website name teachbook, which essentially sounds a lot more helpful and useful and practical then stupid facebook. I hope somehow then end up losing money on this.

This is the greatest thing that could have happened to Teachbook. Hell, they may have even worked with Facebook to make this happen. Free publicity is hard to find. This could help put them on the map.

Isn't there a movie coming out soon about when facebook first got started and they were being sued for being too much like someone else's idea?

Nice to see that they've become the assholes that they once had to defend their selves from.

Does Facebook know that books are used a lot more for teaching than for faces?

To me it reminds me of Apple sueing or threatening to sue anyone that put a lower case i infront of iAnything.

    Why don't they sue pornbook.com

I'm not sure she can deliver that over the net, unless it involves the use of your vacumn cleaner and her making slurpy noises

Education could use a good social networking site that can be a place to share and collaborate without all the useless random crap that happens on Facebook. I work in Education IT and social networking is a hot topic and teachers have tried to petition that facebook be open and allow teachers to share facebook pages of themselves and for clubs but it is always turned down because much of what happens on facebook can be innappropriate in a school environment.

This reminds me of my other favorite company, Monster Cable. They've previously sued Monster.com and Disney, because of Monster's Inc., according to this 18-month old WSJ article. Looks like Lamebook is trying to copy their business "model".
