Biggest ever pirate CD bust in U.S.
Three men have been indicted following what is being called the biggest ever bust of pirated CDs in US history. The three men, Ye Teng Wen (29), Hao He (30) and Yaobin Zhai (33) were arrested last week on charges of illegally replicating 325,000 music and software CDs. A spokesman for the U.S. Attorney of North California said two of the men were American citizens and one had a U.S. work permit.

"The allegations of massive piracy of music and software reflect the potential loss of millions of dollars to the artists and businesses who legitimately own the copyrights on these works," U.S. Attorney Kevin Ryan said in a statement. "These individuals are charged with affixing counterfeit labels on CDs to create the appearance of legitimacy, including the FBI Anti-Piracy Warning that stated 'Unauthorized copying is punishable under federal law.'"



Many Symantac security software packages were found amongst the pile as well as copies of Adobe Photoshop CS. There was also a large amount of Latin music found. The counterfeit discs circulated widely with one of them found at a store in Chicago. The three have been released on bail and are due in court on October 27th. It is estimated that piracy costs the entertainment and software industries tens of billions of dollars.

    IMO, these scumbags should be thrown in prison. downloading for loading onto your ipod or media player is one thing, but mass cloning in order to make large scale fraudulent profit (potentially tens of millions) is another.

    When that happens they dont lose 80 bucks because the person never would have bought the software, they just didnt make $80.

    Same thing with cd's. Someone isn't going to buy a certain cd for 13 bucks but they will get it for free or for a few bucks. So the artist didn't lose $13 because they were never going to have it in the first place, they just didnt make 13.

    I think that figure is bloated and full of crap.

    I'd have to agree with you jasper. Most (if not all) pirated software goes is pirated by people that wouldn't buy it anyway. Many times is because they cannot afford it. For example: everybody wants microsoft office, but they get stuck with Worksuite or wordperfect and they do not want to drop $100's on the office suite. I am fortunate enough to Sr. Network tech for a school district so virtually every software they purchase I am automatically given a license for. It works out nice. I get Office, the Adobe suites, and all sorts of other programs. And since we license most of our software per user and not per machine I can install it at home. Its legal... I checked :)

    OH... and I feel that most companies lose more money fighting piracy than if they were to invest in ways to embrace P2P and make it affordable for everybody. Not everybody is willing to pay 99 cents a song that they have to burn themselves and not get the total package like the CD artwork and information. Just a thought.

    I agree, people who profit from piracy deserve to be caught, but this is really a waste of time. The music industry has its priorities mixed up. They shouldn't be fighting against piracy; they should be competing against it. Pirates make a load of money selling CDs for a quarter the price they cost in stores, so I think if the music industry lowered their prices by 75%, they could still turn a handsome profit too. But it seems the music industry would rather be greedy than smart...

    Ya know I don't feel a bit sorry for these overpriced Software and music companys that have taken lots of my cash when I was A kid, and if they were loosing so much money as they like to whine about they'd be belly up already, but you can't justify someone downloading a song or a program for free and say it's not the same thing, as say selling half a million bootleg cds (give or take a few hundred thousand), sorry but stealing is stealing anyway you wanna put it. Now I think I'll get back to my limewire downloads.

    I think that it is ok to download movies, music, ect. if you are doing it for yourself and not for profit. Especially if you've already paid to see it previuosly or regularly go to the movies. You are supporting their interests and they are making a lot of money. You are also paying to rent the movie to watch if your copying it that way and that is even more money for the industry, as well as buying blank DVDs, labeling if your not a Sharpie fan, and the various recorders and hardware needed to make your own private copy.
    I lived in the Caribbean for 4 years and they rented movies that proclaimed on them in bold print on the films that they were films that were academy award contenders. This means that some rich member of the academy awards either sold them or gave them (doubtful)to the privately owned rental places who in turn mass produced them and then rented them out. We were able to veiw movies well in advance of them being released in the USA. This seems to be more of a crime to me.
    I agree with aabbccdd that BiGsAl should lay off on the Bush Bashing, that is not what this forum is about.

    to all you people that think piracy is that bad try spending 6months in prison sharing a cell with a convicted murder for burning a few cds.ONe of my friends use to work in a shop owned by his cousin and due to a tv program today tonight(similar to 60minutes,current affairs type show) the guy lost the shop and had to destoy thousands of pirated movies which he was only selling to customers he personally knew for $5 a cd.Not a lot of profit when your selling copied cds for $5 each.as for software and record labels they mass produce cds at a cost of about 5cents each then the shops are selling them for up to $100 each.so what if some of us would rather pay less and get a copied cd.at least were not going out and committing crimes to pay for our cds.

    It's kind of sad to see these industries and law enforcement exercise their right to arrest and prosecute. The same companies that sign these artist to both movie studios and record companies manufacture and distribute everything needed to record movies and music legally. Just think people have made a profit on what is called bootleg material in music dating back to the 70 & 60's with 8 track tapes and even long before that. For a long while this issue was dead. Through out the 80's and 90's when music was basically copied to cassette, It was nothing to know or see anybody anywhere buying copy or mass producing music which was sold traded or simply duplicated for private use. Remember the "SONY WALKMAN" Well there seem to be no big stink when cassettes where the media of choice for duplicating music. If it's illegal to copy sell or mass produce DVD video or music privately then it should be illegal also to manufacture and profit from the sales of blank DVD/CD media, CD/DVD copying software, and all associate electronic equipment used and sold to the general for private reproduction of music and video material.

    they can`t take away our right to create our own movies. I enjoy using my camcorder and computer software to put together home movies for family and friends in DVD format. I also have converted my VHS paid for movies to DVD and don`t feel any guilt for doing it. they fact that the entertainment industry can`t create an encryption that hasn`t been broken as fast as they come up with them does my old heart good. DVD will soon be moving into a new encryption with HDCP and I`ve read no version of Windows will play the new HD DVDs except VISTA which will be coming out soon. so if you want to watch your new HD-DVD on your computer moniter you can`t unless you buy windows new OS Vista. It just seems to be closing in all around us, they won`t be happy till they milk us dry

Also, most (possibly all but a few, maybe even all) people here do not commit piracy. Piracy, copyright infringement, and unauthorized copying are all very different things. Most here are probably guilty of the third; some may be guilty of the second, but most are probably not guilty of the former, which is the only one, IMHO, that is truly criminal.

    I see your point brigmeg37 but "priced too high" has nothing to do with ones need to copy or sell copywritten movie media. Convenience is. The use of DVD drives, software, or blank media, is not as wide spread as we think. I think and it's my rough estimate that in a room of ten people at any given time there may be two of those people who own a DVD burner at this time. So it is more than likely in my opinion, If you were to let it be known in jest of converstion or simply bragging that you own what is needed to copy movie media, most would be concerned and even interested in having you show them or explain to them more about technology. This along with people now knowing it can be done well with the drives and software available, can and has prompted a great deal of our associates and family members to request these copies with many offering to pay you because most people rent not buy, also don't own computers and if someone could buy a replicated copy for cost of a rental, most I feel would want to by an illegal copy. The hot seat today is the unauthorized copying of DVD's 5 years ago it was music unorthorized reproduction and downloads. And it's not the poor kid in the hood either. Just think what a college kid perhaps living on campus of any university anywhere is doing with his or her DVD burner? They're making as many illegal copies as they can and selling them realizing that most at this time people do not own or understand the technology needed to reprodduce illegal DVD movie copies. So as the purchase of DVD burners and software becomes more common place the demand will lessen and like cassette tapes of years before recording copywritten DVD's will be what's expected of people who own the technology and wish to do so.

    When blank tapes started being sold, the record companies got mad and went after them. Anybody know the out come??? I do............ Record companies get a cut out of every blank tape sold. Not a big percent true, fallow the paper trail, its long and detailed, but true. Blank tapes are used for more that caopying music, just like blank CDs and Blank DvDs.!. Why not appese their stupidy and let them have a cut of the sales??

    Personally i am for and against downloading and piracy. I feel that P2P networks are a useful tool for testing purposes. Lets start off cheap. I am sure we have all been in a position where we bought a cd and only like one song on it. Well the obvious of p2p netwroks is to download several songs by a partivular artist and decide weather it woul be a good investment of $20. However, i do feel that napster and other networks that charge you a $1 per song. After downloading 10 songs it si cheaper to just buy the cd. More expensive investments such as photoshop (which can be ball parked aroun $700 for cs version) may not be the perfect tool for a picture editor, hovewever you would not want to find this out after purchasing it. Correct.... Even thought there is copy right laws out there, there is a good chance to get by them LEGALLY. For example, i am sure if you asked a few of legitament buddies, you might find a program or cd you like. Or maybe a grooup of ppl you know want the same thing but nnot the HUGE price tag. All you need to do is chip in at least a $1 and technically you own part of that cd or program. Now rather than sharing one copy you burn it to have a copy of your own. BUT BEAWRE for some agreements state that A particular program can only be used ON ONE COMPUTER...

    When there is a program out there that is that freakin expensive, why would you pay for it when you could download it for nothing. There is no reason which is why people cant help themselves when it comes to downloading. Then you come to a program you want and the license fee is $20.     BiGsAl, the FBI has juridiction in the United States. AfterDawn is hosted in Finland. While it will likely change soon (I heard Finland is adopting stricter laws), AfterDawn is currently completely legal. Also, AfterDawn does not encourage piracy of any sort. Unauthorized copying (which is not the same as piracy) is still legal in some places and does, in fact, have legitimate uses.

    for 1 not everyone on this site is american i am not for 1.2 piracy is legal in some asian countries and even if i admitted to piracy my ip changes everytime i log on the internet so it would be hard to track me down and if the FBI or INTERPOLL did track me down it would be thrown outta court due to the fact that they used illegal means to track me.as for INTERPOLL my friends been on the run from them for like 3years and they still cant find he.hes murdered at least 30 people.INTERPOLL have better stuff to do then crack down on piracy.i dont know the copy right laws in finland so i cant comment on this site except that if this site is gonna get in trouble it will be in finland and not usa.as usa laws only apply to people in usa.

    I believe it is fair to say that if I were a member of the league of vampires (the motion picture and music industry of america),I would most likely lament the loss of extra mercedes', multi-million dollar homes and new swiss bank accounts that pirating in one form or another deprives them of. But in all honesty I do not feel pity nor shed a tear for those who have to much already and look to go after and make examples of the average joe to warn the rest that they may be next. For every one they prosecute a million more there will be. Piratism cannot be stopped, it will just evolve against every obstacle. This is not to say I condone the actions of ones like those mentioned in the article above, that's just plain greed and stupidity. Profit should not be the goal, it should be sharing.

    you could also point out that the people complaining about piracy are also taking part in it.think about it,who is one of the biggest complainers about piracy...SONY!but they make dvd burners and blank dvdr's.which you obviously need to pirate their stuff. who really needs a dvd burner to store 5-9gb of files onto one disc? or who has that many home movies to warrant a 100pk spindle of dvdr's? (maybe an amateur porn star).so sony knows that they are making money on people backing up their movies and games that they own and from pirates that steal sony movies and games.you know sony burners sell like hot cakes as well as their media because of that fact.

    The movie and music industry, like any other business is profit motivated. Additionally most of these companies are publicly owned and must answer to the shareholders (me and you or someone you know) who demand a profit.

    The music industry has suffered in large part to a poorer quality product due to their focus on band appearance rather than the music. This resulted in huge profits in the short term with short-lived acts and left talented musicians to make it on their own. Recording artists get somewhere around a dollar per CD after production costs are met. Many do not pocket much money from CD sales, which is why some support giving their music away. This increases the band following allowing them to sell more concert tickets, where they can make some money. (bought a Stones ticket lately?)

    In any year many movies are produced; some that make a huge profit, some that are box office bombs, and many in between. And some that don’t get past the test market and go right to DVD. If the studios knew beforehand that a movie would result in red ink, it obviously wouldn't see the light of day. The successes help offset the failures.

    DVD sales have opened up a new avenue for the studios to increase the likelihood that a movie will result in a profit or enable them to reduce their losses. This allows the studios to take more risks in the movies it chooses to make. Some would contend that this results in lower quality films. But it also results in some good movies that are not appealing to the movie going public (mostly teenagers), and instead enjoying success in the DVD market.

    It appears most here are against piracy and support copying a movie or CD that you do not own for private use. Some have rationalized that the studios make too much money so their actions are justified (I suppose they are looking at the studio’s balance sheet). Others have indicated that if they copy a movie that they would not have otherwise purchased, then no one loses. And further contend that since the studios get a portion of the proceeds of blank media sales, they do make money and should be happy with that.

    The conclusion that Sony supports piracy by manufacturing DVD burners by a previous writer is ridiculous. Consumers will buy DVD burners. If Sony can make money by selling burners and blank media, then they are going to do it or be beaten out by their competitors. Should a car manufacturer cease to produce cars because they are being used to commit crime? These devices can legitimately be used for home movies, PVR’s, data backup, along with making DVD backups of movies you own.

    While the studios aren’t losing a sale when someone makes a copy of a DVD that he or she would not have otherwise purchased, there currently is no way to permit that while preventing copying one that would have otherwise been purchased.

    I would surmise that most people who copy movies and music for their own use that they do not own are doing simply because they can, more convenient, but mostly because it costs less. The listener supported radio station in my area points out during its fund drives that only ten percent of the people listening will make a donation. The station doesn’t incur any additional expense if I listen. And they don’t even know if I’m listening. But someone has to pay for the programming or it will not continue to exist. By the same token as long as enough people are willing to rent and purchase DVD’s for a profit to be made, they will continue to be there.

    As a software developer, if I spent my time and money developing marketable software only to have the public decide they should be able to obtain it free of charge, I would fight it as well.

    I don’t see merit in your position. Would you suggest the police stop ticketing speeders because everyone is doing it? Or because the technology exists to put a speed restrictive device in a car that reacts with a signal on the road and limit the speed of the car to the posted limit? It isn’t necessary to put anybody in jail. Fining will deter the vast majority. As a taxpayer, I want my government to be fiscally responsible. If the government is spending money unnecessarily, then it is the taxpayers who bear the cost. However the government has a financial interest in this. The industry pays taxes and employs a great many people who also pay taxes.

    If you were to intentionally leave your car running with the keys in the ignition while you run into the store and the car was stolen, is the thief any less guilty than had he picked the lock? Would you not expect the police to treat it as a crime and try to recover your vehicle and bring the thief to justice? The movie industry is not asking the government for prevention, as in your analogy, but rather legislation and enforcement. If a burglar wants to break into your home, he will find a way to do it. Banks take action to lessen the chance of robbery but it still happens. For years the credit card industry and to a lesser degree, the insurance industry, ignored fraud because it was such a small percentage of their business. They are now taking notice.

    The dilemma here in my opinion is how to allow consumers to make legal backups of purchased media and prevent file swapping, piracy, and illegal copying. You are insinuating that either there is an easy solution or that the industry isn’t financially committed to finding it. I disagree with both of those assessments.

    I don’t find fault with Sony manufacturing DVD burners, as previously stated. They do have legal uses. Should Sony not make burners because the other studios are not making their movies difficult to backup while their competitors continue to sell them? While I don’t support the copy protection that prevents the consumer from making backup copies of purchased media, it sounds as though you would not find fault with Sony if all the studios put copy protection on.

    This isn’t all that different than patents and the protection they’re afforded.
