Man faces $210,000 fine for selling counterfeit software
A judge has ruled today that Matthew Miller of Delaware must pay $210,000 in damages and court costs for selling hundreds of counterfeit copies of popular software on the auction site iOffer.

The Business Software Alliance (BSA) adds that the software includes Photoshop, Office and software from Autodesk. Miller would pirate copies of the software, burn them to DVDs, and sell them to customers for about $10 USD.



Miller was caught after he agreed to sell $11,900 worth of software to an undercover agent for $45 USD.

The fine is $195,000 in damages and another $15,000 in court costs and lawyer fess. Miller must also delete all "infringing" copies of the software in "his posession."

Jenny Blank, the BSA's senior director of legal affairs, added: "In the course of our efforts to stop software piracy, BSA and its member companies rarely take action against individuals. We prefer to educate and inform the public about the risks and consequences of using illegal software. But there are instances when the activities of individuals are both reprehensible and blatant, requiring the BSA and its members to act swiftly and definitively."

"This kind of piracy is arguably one of the most devious types of Internet-based piracy because it involves actual sales of unlicensed software to consumers,"
says Blank. "Consumers should be aware that the majority of these 'too-good-to-be-true' offers originate from unscrupulous vendors. Not only are the products and services offered by these individuals often shoddy, counterfeit or downright fraudulent, but the consumer may be tricked into giving away sensitive financial and identifying information. You may think you're saving money, but in the end, it could be far more costly."

    That's utter crap. That chick who just shared like 21 songs has to pay like 10 times as much as a scumbag who counterfeited programs worth 100's of dollars for profit. Something is seriously wrong with the US justice system.

    canuckerz, that is the law, the justice system just carries out laws made by crooks.

    I thought it interesting that they were implying a counterfeiter is more apt to steal your idenity than the persons selling stolen goods or stuff that doesn't work. They are the ones I don't trust.

    Now these damages are a bit more reasonable. They are still crazy (at a little over 10x the software's "worth") but it's much more reasonable than the RIAA's $1.92 million "judgement".

    ITS ALL ABOUT FREE fck this loser i hope he rots in hell he should have burned them for the exchange of a spindle of dvd's. this guy was making money off someone else work. but in reality no software is worth $11,900. and anyone willing to sell blatantly pirated software will have no moral issues with including litmus and starting there own private botnet to farm some cash for bail money :D

    I agree with you but you forget the problem Hopium he was using another company software found a way to delete the DRM from it and sell it for profit, the good thing is the BSA I respect more is they don't go after people who don't know they are paying a pirate..also why it is that high is due to it was originaly from another copanty he is stealing profit from..even though in reality he sould be fined 2 million other then what was said. The price he has to pay should be what "File Sharer" Jamie Thomas has to pay and this ass hole should pay what Jamie should.

    What was interesting though is the court case does explain why like the FBI and the RIAA and MPAA may go after people is pirates who make sites that look legal use your own information to report to the authorities thats probably why crap like these copyright cases start to begin with. Even though they didn't say that, the just said they can use your information. I'm just implying that's what they could do and may all ready have to hurt consumors

    Download what you need from the monopolies and leave the rest. Adobe photoshop can be had for the greatest price on earth free if you know where to look. sometimes i prefer the alternative GIMP is an awesome program often over looked.

    Child porn is a interesting issue how do you balance out the the need for it and yet still protect minors. Well first off anyone involved with the production of child porn gets life(or a bullet in the head), anyone selling child porn gets life(or a bullet in the head) minors involved with it are checked to ensure they are not part of it and merely the victim of it.

    Next allow fictional images and photo shopping of child heads onto adult bodies(yes that's a crime currently, as is hentai for the most part). Next you either make possession not a crime its just something that can not involve money making or you make it about as bad as involuntary manslaughter, and that's per count indent not 200 pics equal 200 kills... oh gaawww...we are burning down the world for the sake of "for the appearance of morality".......

    Lobbying is such a great word isn't it? Yet another word made up by the establishment to make people think corruption and bribery aren't part of the process involved in making laws.
    Seeing a case like this puts things into perspective, if only for a moment.

    Thats why lobbying is the root of the problem remove the ability of to donate and gives gifts of more than 5K for any person or organization, and if its found any organization funneling money to a single person or party not only dose the fed take the money the person in question is fired losing all befits, remove the ability for paid lunches. And for christ sake don't let any house/senate state or other wise politician become a lobbyist.

    Ok maybe not how about this if they have more than 5M in assets they get nothing but discounted housing and free security. Gifts,trips,ect are banned if you get anything you are removed from office if its over 10K(goods or cash) you go to jail for an hour of every 1K over 10K and are banned from public office for life by being marked as a felon.

    These people in federal government need to be brought back down to earth.......
